These Terms of Use & Service (“Terms”) govern your use of this website and, where applicable, the purchase of equipment, installation services, support, and related offerings provided by Borkovic Media Inc., through its division Borkovic Media Sports (“BMSports”), which itself includes the CurlCast division (“CurlCast”).
In these Terms, “BMSports,” “we,” “us,” and “our” refer to Borkovic Media Inc. acting through Borkovic Media Sports (and its subsidiary CurlCast division where applicable).
By accessing or using this website, you agree to these Terms. If you do not agree, please do not use this website.
If you purchase products or services from BMSports or CurlCast, the customer terms in Sections 13 through 28 also apply to you.
This website is a public information and sales website for BMSports. It is intended to provide information about our services, installation offerings, equipment, facility types, and ways to contact us or request a quote.
This website is not the BMSports viewing platform, customer dashboard, or customer web application. Those services may be subject to separate terms, customer documents, privacy disclosures, subscription conditions, or service arrangements.
Using this website, sending us a message, or requesting a quote does not by itself create a customer relationship, contractor relationship, partnership, or binding service agreement between you and Borkovic Media Inc. or BMSports.
Any services, installation work, project scope, pricing, scheduling, support obligations, travel, or related commitments must be confirmed by BMSports through payment, written approval, an invoice, quote, proposal, work order, or other written confirmation.

Your continued use of this website after revised Terms are posted constitutes your acceptance of those revised Terms. For customers purchasing products or services from BMSports, the version of these Terms in effect on the date the applicable quote is approved, the order is placed, or payment is first made will apply to that transaction, unless otherwise agreed by BMSports in writing.
These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.
For Equipment, Installation, Warranty, and Support
The following sections apply only to facilities, clubs, venues, schools, organizations, or other customers that purchase products or services from Borkovic Media Inc. through Borkovic Media Sports (which itself includes CurlCast where applicable).
A facility or customer (“Facility”) agrees to these customer terms by doing any of the following:
For certainty, payment of any deposit or invoice amount constitutes acceptance of these Terms in full.
BMSports may provide one or more of the following:
The exact products and services included in a project will be determined by the applicable quote, invoice, proposal, or other written confirmation issued by BMSports.
Until full payment is received, title to physical equipment supplied by BMSports remains with BMSports.
Upon full payment of the applicable invoice, title to the physical equipment supplied by BMSports transfers to the Facility, unless otherwise expressly stated in writing.
This includes, where applicable:
After title transfers, BMSports retains no ownership interest in the physical equipment itself.
The Facility may own the physical equipment it purchases, but BMSports retains all right, title, and interest in and to its software, dashboards, streaming systems, app features, platform tools, workflows, configuration methods, branding, and related intellectual property.
No hardware sale transfers ownership of any BMSports or CurlCast software or intellectual property.
Where access to a platform or service is subscription-based, continued access requires an active subscription or service arrangement.
By proceeding with a project, the Facility confirms that it has the authority to approve installation work within the premises.
The Facility authorizes BMSports to install equipment and related infrastructure in mutually approved or operationally appropriate locations within the Facility. Installation activities may include:
The Facility is responsible for:
The Facility is solely responsible for the ongoing physical security, care, custody, and protection of all installed equipment after installation is complete.
Complete Release of Liability
To the maximum extent permitted by law, you completely release BMSports from any and all liability, claims, or damages whatsoever arising from work not performed directly by our authorized technicians, including:
If equipment is installed, moved, removed, rewired, remounted, altered, or otherwise handled by the Facility or by a third party, BMSports bears absolutely zero liability whatsoever for any resulting damage, personal injury, structural failure, or service issue. You accept sole and exclusive responsibility for all risks, damages, and consequences stemming from unauthorized installation or handling.
Once installation is complete and ownership of the equipment has transferred, the Facility assumes full responsibility for the custody, physical security, condition, and protection of all installed equipment.
BMSports is not responsible for any loss of or damage to installed equipment caused by:
All quoted and invoiced amounts are due in accordance with the applicable quote or invoice terms.
All sales and installation services are final. No refunds will be issued for:
If the Facility cancels a project after approving the work but before completion, BMSports may retain or charge for: deposits paid; equipment already ordered or allocated; labor already performed; configuration work already completed; any non-recoverable project costs incurred.
Nothing in this section limits any express warranty specifically provided in Section 22.
BMSports provides a limited two (2) year warranty on BMSports- or CurlCast-supplied cameras and hardware beginning on the date installation is completed or the date of delivery, whichever occurs first.
If BMSports determines that a covered product supplied by BMSports is defective due to a fault in materials or workmanship under normal intended use, BMSports will, at its option:
This limited warranty applies only to hardware supplied directly by BMSports and only to defects in materials or workmanship under normal intended use.
This warranty does not cover:
Where a covered hardware item is found to be defective, BMSports’ warranty obligation is limited to repair or replacement of the defective item itself.
The Facility is responsible for all labor and costs associated with accessing, removing, shipping if required, reinstalling, reconnecting, or recommissioning a defective item, unless BMSports expressly agrees otherwise in writing.
BMSports may provide remote or on-site support as described in the applicable service arrangement, subscription, quote, or project documents. Unless otherwise stated in writing:
BMSports may update its support processes, personnel, and service structure from time to time.
Certain parts of the system may depend on third-party services or infrastructure, including:
BMSports is not responsible for outages, interruptions, degraded performance, or failures caused by third-party services or Facility-controlled infrastructure.
To the fullest extent permitted by law, BMSports will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of revenue, loss of goodwill, loss of streaming availability, loss of business opportunity, or loss of data, arising out of or related to the equipment, services, platform, installation, support, or warranty.
Without limiting the foregoing, BMSports is not liable for:
To the fullest extent permitted by law, BMSports’ total aggregate liability arising from any claim related to the applicable project, equipment, or services will not exceed the amount actually paid by the Facility to BMSports for the specific equipment or services giving rise to the claim.
These Terms, together with any applicable quote, invoice, proposal, work order, subscription, or other written agreement issued by BMSports, form the entire agreement between the parties regarding the subject matter addressed herein and replace prior discussions or understandings on that subject matter.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
